THE COVERED PARTIES FURTHER DISCLAIM ANY WARRANTY THAT (A) THE SERVICES AND SOFTWARE WILL MEET YOUR REQUIREMENTS OR WILL BE CONSTANTLY AVAILABLE, UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE USE OF THE SERVICES AND SOFTWARE WILL BE EFFECTIVE, ACCURATE, OR RELIABLE; (C) THE QUALITY OF THE SERVICES AND SOFTWARE WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS OR DEFECTS IN THE SERVICES AND SOFTWARE WILL BE CORRECTED.
Ramalogy (‘the company’) disclaims all warranties and conditions, including merchantability, fitness for a particular purpose, performance, accuracy, reliability, and non-infringement. The Company does not warrant that the software will be uninterrupted or error-free, that defects will be corrected, or that it will meet your specific requirements.
Liability Limitation : The Software is provided without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company shall not be held liable for:
You (‘user’) are solely responsible for determining the appropriateness of using the software and assume all risks associated with its use, including errors, legal compliance, and damage to or loss of data. In no event shall the Company’s total liability exceed the amount paid by the Client for the Software license or service agreement. All payments made for the Software are final. Once the Software has been delivered, activated, installed, or used by the Client, no refund, return, or cancellation will be permitted under any circumstances.
The Client shall not copy, reproduce, distribute, modify, reverse engineer, sublicense, transfer, or resell the Software in any form. Any unauthorized use of the Software is strictly prohibited and may result in immediate termination of the license and legal action by the Company.
During installation, the hospital is registered in the software using its provided contact number and email ID. For any support or assistance, the hospital should reach out to the company only through the registered contact number or email ID.
The company will recognize and respond only to communications received from the hospital’s registered email ID. Any communication sent from unregistered or alternative email addresses will not be considered valid, and the company shall not be responsible or obligated to respond to such correspondence.
The Company provides an offline Hospital Management System (HMS) installed on the client’s local computers. The software operates exclusively within the hospital premises using a client-server architecture.
For offline software installations, the Company has no real-time monitoring or remote access. All data processing and operational accuracy depend solely on the user’s local system, and the Company shall not be liable for any errors or issues arising from the offline environment.
The software is licensed for use exclusively within the physical premises of the hospital for which it has been registered and installed. The software shall not be accessed, operated, or deployed from any location outside the hospital premises, including remote systems or external networks
User Transactions & Entries : All entries, modifications, and transactions made in the Software are performed at the discretion of the Client’s authorized users. The Company is not responsible for errors, inaccuracies, or fraudulent entries made by users.
The company shall not be held liable or responsible for any financial loss, disputes, or administrative conflicts arising within the hospital, including those related to its trust, society, or management, while using the software.
The company does not generate, supply, or distribute any financial data or reports related to the hospital under any circumstances. Access to financial information is available exclusively through the Accounting module within the software, using the authorized credentials provided to the hospital at the time of installation on its server.
The company strongly recommends that hospitals review and verify their financial entries on a regular basis to ensure accuracy and proper record maintenance.
Annual Maintenance Contract (AMC) : Under the AMC, the company provides services including user training, software updates, operating system compatibility updates, performance optimization, and reinstallation support (in case of a server or main system crash). Support and maintenance services will be rendered exclusively during the active and valid AMC period. Upon expiry of the AMC, all support, maintenance, and technical assistance will be discontinued until the contract is duly renewed. The Company shall not be liable for any issues, delays, or losses arising during any period in which the AMC is inactive or expired.
